RESOLUTION NO. 2016-R80 |
A RESOLUTION OF THE PORT ARANSAS CITY COUNCIL ADOPTING THE 2017 FEE SCHEDULE; AND PROVIDING FOR SEVERANCE AND SETTING EFFECTIVE DATE.
WHEREAS, in accordance with the Code of Ordinances of the City of Port Aransas the City Council reviews fees for services each year and sets new fees as needed; and
WHEREAS, the City Council reviewed and discussed the proposed changes at the November 16, 2016 Regular City Council; and
WHEREAS, staff proposed fee changes for the 2017 year and presented at the November meeting. At the December 15, 2016 meeting, Council reviewed said fees and added items for clarification as follows:
? Beach ? Delete reference to Beach Camping ? Annual RV Camping Permit;
? Building & Development ? Building Permit Fees ? delete Demolition Permit;
? Building & Development ? Building Permit Fees ? amend Commercial Drainage Review to read ?Residential/Commercial Drainage Review? - $25.00 plus actual engineering costs;
? Library ? deleting Membership ? Out of State (family @ same address) and add ?Non-Resident Card Fee (outside city limits) $10.00;
? Marina ?Facility/Equipment Rentals ? amendments
o Main Pavilion/day $200.00, half day - $100.00;
o Main Pavilion (non-profit)/day $125.00, half day - $62.50;
o Small Pavilion/day $50.00, half day - $25.00; and
o Sound System/day $35.00.
? Marina ?Facility/Equipment Rental ? deletions
o Permit Fee of $35.00; and
o Parking/Storage Daily Fee (after 5th day) $3.00.
? Utilities - Gas ? amendments
o Boring add ?By Contractor? in Services, with ?Cost plus 10%?. Delete ?Comments?;
o Damage to City Property by a 3rd Party ? delete ? ?Tampering with City Facilities (unauthorized)?; and
o Amend fee for Reconnection Fee to $26.00.
WHEREAS, staff received notification from the Texas General Land Office (GLO) that a Beach Camping ? Annual RV Camping Permit of $40 could not be charged as it was not included in the City?s Coastal Management Plan (Plan). The Plan is presently being updated and upon approval by the GLO and the City Council, fees will be reviewed, evaluated and fees be reinstated.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARANSAS, NUECES COUNTY, TEXAS:
Section 1. Upon City Council review and approval the 2017 Fees for Service Schedule dated December 15, 2016 is amended in the following category by adding making the following changes as shown below and included in Exhibit 1 attached hereto.
Section 2. The 2017 Fees for Service Schedule dated 12/15/2016 with the changes shown shall become effective on January 1, 2017. Any previous adopted Fee Schedule Resolution, and any subsequent amendments, which are in conflict with this Resolution, is hereby repealed.
Section 3. It is hereby officially found and determined that the meeting at which this Resolution was passed was open to the public, and that public notice of the time, place and purpose of said meeting was given as required by the Open Meetings Act, Texas Government Code Chapter 551. Notice was also provided as required by Chapter 52 of the Texas Local Government Code.
PASSED and ADOPTED at a meeting of the Port Aransas City Council on this the 15th day of DECEMBER, 2016.
